The way to construct an overflow is to bring the actual pipe in lower than the intended level, with a slight fall on the pipe. Join this to an elbow and fit pipe into the elbow to come to more or less the surface level. Fill the pond, and then trim the pipe so that it is level with the finished water level. The pipe should be say 4 inches, or thereabouts. Fish are not likely to get caught on this pipe as the miniscus of water running over the overflow will be very small indeed. In addition given the larger diameter the flow velocity is not so great a fish could not escape. HTH
